The terms that govern use of the ActiveAdsNext website and participation in our affiliate network.
These Terms & Conditions ("Terms") govern your access to and use of the ActiveAdsNext website, forms and any related services (together, the "Website"), and, where applicable, your participation in the ActiveAdsNext affiliate network as an advertiser or publisher. By using the Website or submitting a form, you agree to be bound by these Terms. If you do not agree, please do not use the Website.
Where you enter into a separate advertiser or publisher agreement with us, that agreement governs the specific terms of your partnership, and these Terms apply to your general use of the Website in addition to it. In the event of a direct conflict, the specific advertiser or publisher agreement controls for matters it expressly addresses.
Our Website and network are intended for businesses and professionals. By using the Website or applying to join our network, you represent that you are at least 18 years old, are legally able to enter into binding agreements, and are accessing the Website for legitimate business purposes.
You agree to use the Website only for lawful purposes and in a manner consistent with these Terms. You agree not to: interfere with or disrupt the Website's operation or security; attempt to gain unauthorized access to any part of the Website or related systems; submit false, misleading or fraudulent information through our forms; or scrape, copy or republish substantial portions of the Website's content without our prior written consent.
Advertisers who submit an offer through our Get Started form, and are subsequently onboarded, agree to provide accurate information about their offer, pricing, eligibility criteria and payout terms, and to honor the payout terms agreed for qualifying actions attributed through our tracking system. Advertisers remain solely responsible for the products, services and representations made on their own landing pages and in their own creative assets.
Publishers who apply through our publisher application, and are subsequently approved, agree to promote only offers they have been authorized to run, to represent those offers accurately, to comply with our Affiliate Disclosure requirements, and to use only the promotional methods and traffic sources disclosed during application unless we agree otherwise in writing.
We use tracking technology to attribute clicks, leads and conversions to the correct publisher and advertiser. While we design our tracking to be accurate and take reporting discrepancies seriously, tracking can be affected by factors outside our control, such as browser settings, ad blockers, or third-party technical issues. Payouts are made on the schedule and terms set out in the applicable publisher agreement, and are subject to reversal where an underlying action is later found to be invalid, fraudulent, or non-qualifying under the relevant offer terms.
Regardless of your role, you agree not to: generate or attempt to generate fraudulent clicks, leads or conversions; misrepresent an offer, your traffic sources, or your identity; use spam, malware, incentivized traffic that violates offer terms, or deceptive promotional methods; or otherwise attempt to manipulate tracking or reporting in your favor. Violations may result in withheld payouts, suspension, or termination as described in Section 11.
The ActiveAdsNext name, logo, and Website content (excluding advertiser and publisher materials) are the property of ActiveAdsNext or our licensors. Advertisers grant publishers a limited, non-exclusive license to use provided creative assets solely to promote the applicable offer, for the duration of the relevant campaign.
The Website and our services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by applicable law. We do not warrant that the Website will be uninterrupted, error-free, or that tracking and reporting will be free of discrepancies.
To the fullest extent permitted by applicable law, ActiveAdsNext will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Website or participation in our network, even if we have been advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law.
We may suspend or terminate your access to the Website, your advertiser account, or your publisher account, at our discretion, where we reasonably believe you have violated these Terms, an applicable advertiser or publisher agreement, or engaged in fraudulent or harmful conduct. Where reasonably possible, we will provide notice of the reason for suspension or termination.
These Terms are governed by the laws of India, without regard to conflict-of-law principles, and any dispute arising under these Terms will be subject to the exclusive jurisdiction of the courts located in Haryana, India, unless a separate advertiser or publisher agreement specifies otherwise.
We may update these Terms from time to time to reflect changes in our practices, our network, or applicable law. We will post the updated Terms on this page with a revised "Last updated" date, and continued use of the Website after changes take effect constitutes acceptance of the updated Terms.
